Medical Malpractice in Organ Transplant Surgery

Medical malpractice in healthcare has been widely studied, but when it comes to organ transplants, research is surprisingly limited. A recent study, published in Frontiers, set out to fill this critical gap, shedding light on the risks and legal complexities surrounding these life-saving procedures.
Researchers looked at a selection of cases involving malpractice from 1988 through 2023 involving organ transplants. Each of the cases was classified into one of six malpractice categories:
- Surgical Errors (31.8%) These included mistakes during and after surgery, such as incorrect tube insertion, failure to clamp arteries, and surgical instruments that mistakenly stayed inside the body.
- Medication & Treatment Errors (26.1%) These mostly involved incorrect medication use, leading to transplant rejection or adverse reactions.
- Quality of Care & Monitoring (13.6%) This included inadequate post-transplant monitoring, delays in critical care, and insurance-related denials.
- Organ Quality & Donor Issues (11.4%) This involved transplants from donors with undisclosed risks (e.g., history of drug use, underlying health conditions).
- Misdiagnosis & Delayed Treatment (9.1%) This included failure to monitor patients properly, misdiagnosed complications, and delays in necessary care.
- Patient Rights & Informed Consent (6.8%) Some patients claimed they were not properly informed about the risks of their transplant.
Among the cases reviewed, a heart transplant patient died after an error during surgery, resulting in the largest settlement of $19.9 million. A kidney transplant recipient was given an organ from a donor with an unknown infection, leading to serious complications. A liver transplant patient developed hepatitis B due to undisclosed donor risks. A patient lost a kidney when it was accidentally discarded.
The most common organ involved was a kidney (46.8% of cases). The most frequent allegations were surgical errors and complications, and medication and treatment mistakes.
