Duffy Firm Construction Injury Case Makes List of Top PA Settlements for 2023
(Philadelphia) – A Duffy Firm construction accident case was named among the PaLaw Largest Awards and Settlements of 2023. In the case, Fitzpatrick v. Toll Brothers et al, The Duffy Firm secured just over $7 million for our client, an insulation installer injured on the jobsite.
PaLaw, a supplement of The Legal Intelligencer and Pennsylvania Law Weekly, annually ranks Pennsylvania’s largest awards and settlements. In this, the 30th edition, the Fitzpatrick award ranked 18th in the commonwealth.
The case involved a 54-year-old insulation installer who fell on a job site in Lehigh County in October 2019. At issue was an unmarked, improperly covered hole. When Fitzpatrick picked up a piece of plywood that he assumed was scrap, he fell about 20 feet to the basement below, resulting in a traumatic brain injury, broken bones, and nerve damage.
The defendants included general contractor Toll Brothers, L&W Supply Corp., Advanced Drywall Systems, and Johnston Built LLC. The construction companies ultimately agreed to the settlement a few days before the case was set to go to trial in the Philadelphia Court of Common Pleas.
